Ontario Foreign Workers is one of the streams of the Employer Job Offer of OINP, a PNP administered by the province of Ontario. International Companies points out that foreign citizens with professional work practice occupy a legitimate job offer from an Ontario company. To pass, the business offer and Ontario company must meet several conditions. As well, the immigrant worker must meet specified qualification requirements regarding past skilled work practice.

Applicants who are successfully chosen through this stream of Employer Job Offer will be called to submit an approved application for Canadian permanent residency.

Foreign Workers Employer Job Offer – Eligibility Requirements

To get eligible for this stream, you must follow these requirements for applying quickly.

Job Offer

To pass for the Ontario Foreign Worker program, a foreign citizen must have a legitimate job offer from an Ontario company. The job proposal must be full-time and paid above the medium wage level for that profession in Ontario. The status must be at NOC work level 0, A, or B.

Work Experience or Licence

Any person practicing this program must meet one of the following conditions:

1. Work Experience:

The applicant must have at least 2 years of professional job experience gained within the previous 5 years. This work practice must be in the same NOC code as the profession listed.

2. License or Authorization: 

The applicant must prove that they hold a legitimate license, certificate, or permission to experience the profession intimated on their Ontario job proposal.

Purpose to Reside

All candidates for the OINP Program must declare their intention to continue in the province. This can be determined by links to the province, purchases, or works to associate in Ontario society.

Qualified candidates can submit an EOI through the e-Filing gateway of OINP for the possibility of being called to apply for nomination. Forms are listed on an OINP points-based policy. The highest-ranking applicants will be issued an ITA to apply.

Employer Requirements:

General Requirements

To qualify under the Foreign Worker Stream, your employer must:

  • Have been in active business for at least three years prior to submitting your application.
  • Have business premises in Ontario where you will work.
  • Have no outstanding orders made against them under the Ontario employment standards act, 2000 or the occupational health and safety act.
  • Demonstrate that enough effort was made to recruit a Canadian citizen or a permanent resident prior to offering the position to you (This only applies if you are currently living outside Canada or working outside of Ontario).

Revenue Requirements

Your employer’s business must also meet the following requirements for the most recently completed fiscal year (the year used for tax or accounting purposes):

  • A minimum of $1,000,000 in total gross annual revenue if you will work or report to work at a location in the greater Toronto area (city of Toronto, Durham, Halton, York, and Peel Regions).

Or

  • A minimum of $500,000 in total gross annual revenue if you will work or report to work at a location outside the greater Toronto area.

Meaning of report to work

In cases where the applicant will work at more than one location, the location where the applicant will report to work means:

  • The location where the applicant’s immediate supervisor or manager works, or
  • The location of the administrative office where the applicant will receive work assignments.

Application Procedure

Once an invitation is accepted, the candidate has 14 days to appeal for nomination. If the province agrees with the application, Ontario will inform the candidate chosen for provincial nomination.

After receiving a provincial proposal, a candidate must submit a governmental application for Canadian permanent residency. Candidates in this program must finish and submit a paper-based application. Paper-based PNP requests for permanent residency are treated within 18 months.
